These Terms of Service ("Terms") govern your use of the earmarkIQ mobile app and related services ("the Service"), provided by earmarkIQ Ltd, a company registered in England and Wales (Companies House number 17056081, registered office address: Flat 3, Ash Lodge, Northbourne Road, London, SW4 7DS, United Kingdom).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

earmarkIQ Ltd ("earmarkIQ", "we", "us", "our") is an Appointed Representative of Finexer Limited (FCA firm reference number 925695) for the purposes of providing account information services under the Payment Services Regulations 2017. We are registered with the Information Commissioner's Office (ICO registration number CSN2001882).

2. The Service

earmarkIQ provides a personal finance app that aggregates transaction data from your connected bank accounts via Open Banking, analyses your spending, and surfaces insights, budgets, goals, and AI-powered guidance.

The Service is provided for personal informational purposes only.

Important: Nothing in the Service constitutes financial advice, investment advice, tax advice, or any other regulated financial advice.

The Service provides information, summaries, and general guidance based on your transaction data and your inputs. AI-generated content, including the "Ask IQ" feature, weekly briefings, and personalised insights, is informational only.

You should consult a qualified financial adviser, tax adviser, or other regulated professional before making any financial decisions. We are not liable for any decisions you make based on the Service.

We may suspend or terminate accounts that breach these Terms, that we reasonably suspect are involved in fraud, or that are inactive for an extended period.

6. Open Banking and bank connections

We use Finexer Limited's Open Banking infrastructure to connect to your bank accounts. By connecting an account, you authorise us to retrieve transaction data, balances, and account information from your bank for the purposes set out in our Privacy Policy.

Bank connection consent lasts up to 90 days and must be renewed. You can disconnect an account at any time from within the Service.

We do not have, and do not seek, access to initiate payments from your accounts except where you explicitly authorise a payment through the Service's payment features.

7. Subscriptions and payment

The Service offers a free tier and paid subscription tiers (Plus, Pro, Unlimited). Subscription prices, message quotas, and feature inclusions are shown in the Service and on the App Store.

Subscriptions are billed through the Apple App Store and are subject to Apple's terms.

9. AI features

The Service uses third-party large language models, including those provided by Anthropic, to generate insights, answer questions, and provide coaching. AI output may be inaccurate, incomplete, or out of date. You should verify any information you intend to rely on.

We do not guarantee the availability, accuracy, or fitness for purpose of AI-generated content.

10. Affiliate links and recommendations

The Service may display product recommendations or comparison links that include affiliate relationships. Where we earn a commission from a referral, we will disclose this within the Service.

Affiliate relationships do not affect our recommendations, which are based on factors stated in the Service. You should always do your own research before purchasing any financial product.

11. Intellectual property

All content, software, branding, and intellectual property in the Service belongs to earmarkIQ Ltd or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes for the duration of your account.

12. Service availability and changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may suspend the Service for maintenance, security, or other operational reasons.

We may add, remove, or change features at any time. Where a change materially reduces a paid feature, we will give reasonable notice.

13. Limitation of liability

To the maximum extent permitted by law:
